I would like to clarify what I said to Kenric Ward of the Watchdog.org Virginia Bureau in his article on Green Tech Automotive and that was while we do have serious reservations regarding the claims being made by Green Tech Automotive concerning the viability of their product in the market and the use of EB-5 capital as a funding mechanism for such a large capital intensive manufacturing project, I could not conclude whether or not there was fraud as that could only be determined by a legal process and only after a substantial amount of evidence was presented to support any such claims.

Attorneys Henry Handler and William Berger of the law firm of Weiss, Handler & Cornwell, P.A. in Boca Raton, Florida have filed a memorandum of law in support of the motion to intervene on behalf of EB-5 visa applicant and investors in the IRCTC Chicago Convention Center project.

The case of Neogenix Oncology Inc. should be of interest to EB-5 visa Regional Centers, developers, attorneys, accountants and other service providers and financial institutions who assist, represent and counsel the issuers and EB-5 Centers in their capital raise.  In July 2012 the clinical stage biotech company filed for Chapter 11 bankruptcy due to an investigation by the U.S. Securities & Exchange Commission (SEC) into the company's capital fund raising activities that uncovered payments by Neogenix to unregistered persons.  The liability for rescission associated from payments to these unlicensed finders resulted in the company's inability to present audited financial statements which left them unable to continue raising funds. 

The North American Securities Administrators Association has released their list of the top 10 financial products and practices "that threaten to trap unwary investors." This list was complied by the association's securities regulators in their Enforcement Section. NASAA was organized in 1919 and is described as the oldest international organization devoted to investor protection.
